Terms of Service

1. Accounts

When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

We reserve the right to refuse service or terminate accounts in our sole discretion.

2. Purchases and Subscriptions

Some premium features of the Service require either a subscription or a one-time purchase ("Lifetime Access").

A valid payment method, including credit card or digital wallet (Apple Pay), is required to process the payment. You shall provide us with accurate and complete billing information. By submitting such payment information, you authorize us to charge the subscription or purchase price to your payment method.

Auto-Renewing Subscriptions

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your payment method will be charged for renewal within 24 hours prior to the end of the current period.

You may cancel your subscription at any time through your device's subscription settings. Cancellation takes effect at the end of the current billing period.

Free Trials: Free trials are available for first-time subscribers. If you do not cancel before the trial ends, you will be automatically charged for the subscription.

3. Pricing

Current Plans:

• Free Plan: Free - Basic features
• Monthly Subscription: $1.99/month (auto-renewing) - Full access to all features (3-day free trial for new subscribers)
• Annual Subscription: $19.99/year (auto-renewing) - Full access to all features (7-day free trial for new subscribers)
• Lifetime Access: $39.99 (one-time payment) - Full access to all features

*Pricing may vary by region and currency. Applicable taxes (such as VAT, GST, or sales tax) may apply. The price displayed in the app at the time of purchase is the final price.*

4. Refunds and Cancellations

Subscriptions

You may cancel your subscription at any time through your device's subscription settings. Upon cancellation, you will retain access to premium features until the end of your current billing period. No refunds will be provided for partial subscription periods.

Free Trials: You may cancel your free trial at any time before it ends to avoid being charged. If you cancel during the trial, you will lose access to premium features immediately.

One-Time Purchases (Lifetime Access)

All purchases, including subscriptions and Lifetime Access, are processed through Apple App Store and are subject to Apple's refund policies.

How to Request a Refund

Important: We cannot directly process refunds for purchases made through the App Store. The approval of refunds is at Apple's sole discretion and subject to their terms and conditions.

5. Health Disclaimer

IMPORTANT: WaterBaby is a wellness and fitness tool, NOT a medical device or healthcare service.

The Service is for informational and educational purposes only and should not be treated as medical advice. Our content does NOT diagnose, treat, or prevent any medical condition.

If you have any health concerns, including heart conditions, high blood pressure, or any physical injuries, please consult a qualified healthcare provider before starting any high-intensity exercise program using the Service.

Use at your own risk. We are not liable for any health issues arising from use of the Service.

6. Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of WaterBaby and its licensors. The Service is protected by copyright, trademark, and other laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes only. You may NOT:

• Download, record, or distribute our app content
• Use our content for commercial purposes
• Remove copyright notices or trademarks
• Reverse engineer or copy our technology

7. User Conduct

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to hack, disrupt, or damage the Service
• Share your account with others
• Scrape, copy, or steal our content
• Violate any applicable laws or regulations

Violation of these rules may result in immediate account termination without refund.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

California Privacy Rights (CCPA): If you are a California resident, you have the right to know what personal information we collect, request deletion, and opt-out of the "sale" of personal information (we don't sell data). To exercise these rights, contact hi@noisesleep.com.

9. Third-Party Services

Our Service may contain links to third-party websites or services that are not owned or controlled by WaterBaby. We have no control over, and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

10. Copyright Policy (DMCA)

We respect intellectual property rights. If you believe your copyrighted work has been infringed, please send a DMCA notice to: hi@noisesleep.com.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not warrant that the Service will be uninterrupted or error-free, will meet your specific requirements, or that any errors will be corrected.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: We shall NOT be liable for any indirect, incidental, special, consequential or punitive damages. Our maximum liability to you shall not exceed the amount you paid us in the past 12 months.

13. Indemnification

You agree to defend, indemnify and hold harmless WaterBaby and its employees, contractors, and agents, from and against any claims, damages, or costs resulting from your use of the Service, your violation of these Terms, or your violation of any third party rights.

14. Dispute Resolution

Before filing any legal claim, please contact us at hi@noisesleep.com to attempt to resolve the dispute informally.

Arbitration (U.S. Users): For users in the United States, any dispute shall be resolved through binding arbitration. You may opt out of arbitration within 30 days by emailing hi@noisesleep.com with "Arbitration Opt-Out" in the subject line.

15. Governing Law

For U.S. Users: These Terms shall be governed by the laws of the State of Delaware, United States. For Non-U.S. Users: These Terms shall be governed by the laws of the People's Republic of China.

16. Service Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. If we permanently discontinue the Service, we will provide 30 days' notice.

17. Changes to Terms

We reserve the right to modify these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

18. Export Control

You may not use the Service in any country embargoed by the United States or China, or if you are on any government restricted party lists.

19. General

Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and WaterBaby regarding the Service.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

No Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Assignment

You may not assign these Terms without our prior written consent. We may assign our rights and obligations under these Terms freely.

Language

The English version of these Terms is the official version. Translations are provided for convenience only.
